Protected Disclosure

What is a protected disclosure, and what do we really mean by a whistleblower complaint? 💬

When an employee makes an anonymous complaint, either internally or externally, this is often treated as a protected disclosure. These situations can be tricky to navigate, especially when you don’t yet have all the facts. Is it one person raising a concern about an alleged toxic manager, or is it a broader issue affecting multiple people?

With the rise of AI and LLM tools, and in a job market where people are less likely to vote with their feet, we’re seeing more anonymous complaints. People know their rights and want to be heard, but they also want to remain protected. That creates real challenges for organisations trying to respond fairly, reasonably and lawfully.

The key is not to ignore it, but also not to jump to conclusions. When information is limited, a thoughtful and structured approach matters. That might involve a cultural review or an internal discovery exercise to understand what’s really going on beneath the surface. Finding the facts and understanding the themes allows leaders to act with confidence and integrity.
