What is a Record of Settlement, and when might you need one? 📄💬
Sometimes, an employment relationship can be mutually and respectfully concluded. When that happens, it’s important to document the outcome properly. A Record of Settlement, often referred to as a section 149 settlement, allows both parties to record a full and final agreement that is binding, enforceable, and cannot be cancelled.
These agreements are usually entered into on a without prejudice basis and are designed to give certainty and closure for everyone involved. The Ministry of Business, Innovation and Employment provides template documents online, which can be a helpful starting point.
That said, every situation is different. How the agreement is drafted, communicated and finalised really matters. A well-constructed Record of Settlement protects the organisation, supports a fair outcome, and helps both parties move forward with confidence.
